Surepath Systems India Private Limited, a private limited company with its registered office at Uday Towers, Plot No. 20, S-2 (Shop Space, First floor), MCK Layout, 2 Main Road, Nolambur, Maduravoyal, Tiruvallur, Poonamalee, - 600095 (hereinafter referred to as “Company”, “Surepath”, “We”, “Us” or “Our”) owns and operates: https://surepathsystems.in/ including any subdomains thereof (collectively, “Site”); all related widgets, tools, applications, data, software, APIs, mobile, tablet and other smart device applications including the ‘Zipkee’ application (collectively, “Application”); and services as provided by the Company from time to time. The Site and the Application together are hereinafter collectively referred to as the “Platform.” This privacy policy (“Privacy Policy”) sets forth the manner of collection, use and disclosure of information gathered on the Platform and is in full compliance with applicable laws and regulations, including, but not limited to the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (“DPDP Act”) as well as with the European Union General Data Protection Regulation (“GDPR”) standards. Please read this Privacy Policy carefully. If You do not agree to the Privacy Policy, You may not access or use the Platform. Access and use of the Platform is subject to the terms of service (“Terms”) accessible on the Platform and is to be read in conjunction with the Terms. This Platform is published and maintained by the Company. This Privacy Policy does not apply to the websites of Our business partners, corporate affiliates or to any other third parties, even if their websites are linked to the site. We recommend You review the respective privacy statements of the other parties with whom You interact. By accessing the Platform or otherwise using the Platform, You (hereinafter referred to as “You”, “Your”, “User”, “Guest/s” as applicable) expressly consent to Our collection, storage, use and disclosure of the Information (as defined hereunder) in accordance with the terms of this Privacy Policy, as amended from time to time. By consenting You agree to be bound by terms and conditions of this Privacy Policy, as they apply to You. This document, when published on the Platform, will be an electronic record in terms of applicable laws including the Indian Information Technology Act, 2000, Indian Information Technology (Intermediary Guidelines) Rules, 2011, and/or any other laws as may be applicable to the jurisdiction in which the Platform is being accessed from, and the amended provisions pertaining to electronic records in various statutes. This electronic record is generated by a computer system and does not require any physical or digital signatures.
TYPE OF INFORMATION COLLECTED
While accessing the Platform, the Users may be required to provide certain personal, non-personal and other information, as indicated in this Privacy Policy (such information and correspondences hereinafter collectively referred to as “Information”). Personal Information: We limit the collection of personal data to only that which is absolutely necessary to carry out our legal or business obligations. In some cases, however, the provision of personal data may be partly required by law (for example, tax regulations), is needed as part of or as a result of contractual negotiations, or as part of providing a service. The non-provision of the personal data would have the consequence that the contract or service with You could not be provided or concluded by us, and therefore the same is considered legitimate interest for processing. Personally identifiable information shall include all information that can be used to identify a specific individual or to identify any individual, either directly or indirectly including the following (“Personal Information”): name (including name of the entity and/or its representative), email address, mobile phone number and contact details, delivery address billing address postal code, demographic profile (like Your age, gender, location, etc.), financial information such as bank account, payment card numbers, etc., details relating to orders placed, including but not limited to restaurants selected by You, items ordered, quantity, customisation, dietary preferences, allergies or such other special instructions shared by You, order value, delivery address, preferred time slot, coupon usage, order history, refund history and related details, contents of any communication made by You for raising a compliant, request support, referral programmes, loyalty programmes, campaigns, contests or promotional activities, submitting feedbacks, rating and reviews or otherwise any correspondence with Us, information about You received from restaurant partners in relation to order fulfilment, substitutions, availability issues, order preparation, complaint resolution, refund requests, product feedback, invoices and tax documentation, any information received from delivery partners or logistics partners relating to order collection, delivery status, proof of delivery, inability to reach, address issues, cancellation requests, service incidents and safety escalations, any information received from identity verification providers, fraud prevention agencies, analytics providers, marketing partners, customer support tools, payment service providers and other vendors or affiliates engaged by Us, to the extent necessary to operate the Platform and provide the services, any sensitive personal data information as provided under the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 such as passwords, financial data, data identifying the gender of the person, etc. Please note that the above list is not an exhaustive list and is only an illustrative list and is without prejudice to Our right to seek further Personal Information as may be required and based on Your consent. We will collect Personal Information about You only as part of a voluntary User registration process or any other voluntary process. Any Personal Information provided by You will not be considered as sensitive if it is freely available and/or accessible in the public domain. Further, any comments, messages, scribbles etc. posted/uploaded/conveyed/communicated by You on the public, through reviews, blogs, online chat or instant messages, discussion boards, forums, user testimonials or comments sections of the Platform becomes published content and is not considered personally identifiable information subject to this Privacy Policy. Please note that information such as Your scores, activities, posts and/or other content displayed in Your dashboard on the Platform, are not categorised as Personal Information. Any comments, messages, scores, videos, blogs, etc. posted/communicated by You on the public comments sections of that platform becomes published commented and is not considered personally identifiable information subject to this Privacy Policy. We will be entitled to remove any content posted by any User on Our Platform which We, in Our sole discretion, consider offensive, discriminatory, racist, defamatory or inappropriate in nature. Depending on Your interactions with the Platform, the nature and extent of Personal Information collected may vary. For instance, creating an account may necessitate the provision of Your full name, mobile number and e-mail address. Non-Personal Information: When You visit the Platform, we may collect certain non-personal information such as Your internet protocol address, operating system, browser type, domain and host from which You access the internet, Your internet protocol address, operating system, internet service provider, information about the pages on the Platform You visit/access, the links You click on the Platform, the number of times You access the page and any such browsing information. This type of information does not identify You personally. Information may be collected anytime You access or browse the Platform, not only during the first time. We may also collect information about the services that You use and how You use them, including log-in information and location information, when You are a user of the services through the Platform. Automatic Information: To improve the responsiveness of the Platform for You, We may use "cookies", or similar electronic tools to collect information to understand the User's individual interests. These server logs may include information such as Your web request, internet protocol address, browser type, browser language, the date and time of Your request and one or more cookies that may uniquely identify Your browser. We use cookies primarily for user authentication but may also use them to improve the quality of Our services by storing User preferences and tracking User trends. Using the Platform means Your device will automatically provide information to Us to help customize and improve Our services. This may include technical data such as Your internet protocol address, device identifier, device type, operating system version, and country code for login or signup, as well as usage statistics like pages visited, referring and exit uniform resource locators, time spent, click patterns, platform type, and location data (if enabled). Automated data collection tools may include cookies, web beacons, mobile identifiers, and similar technologies used by Us and Our partners (e.g., advertisers, marketing and analytics providers) to remember settings, authenticate users, deliver personalized ads, analyze usage, and improve functionality. Session ID cookies may also be used for traffic monitoring and are deleted upon logout or browser closure. Log files automatically generated by Your browser or mobile application may include similar technical and usage information. Mobile: When You use the Platform through Your mobile, we may receive information about Your location and Your mobile device, including a unique identifier number for Your device. We may automatically collect device information (such as Your mobile device ID, model, and manufacturer), operating system, version information, and internet protocol address. Location Related Information: When You access the Platform through any electronic device, the Company may collect current location of the user to provide personalized and improved use of the Platform. Further location related information can be based on things such as precise device location, internet protocol address etc. User communications: When You send emails or other communications to Us, we may retain those communications in order to process Your inquiries, respond to Your requests and improve Our services. Payment Information: We do not collect or store complete card details, CVV, PINs, bank account information or UPI credentials on Our systems. Payment method details required for processing a transaction are collected and processed by authorised third-party payment gateway service providers engaged by Us under appropriate contractual arrangements and in accordance with applicable law. Information on behalf of Children: To access or use the Platform you must be of reasonable age i.e. in ideal scenario 18 years of age or older and, if under 18 or the age of majority in your jurisdiction, your use of Platform must be under the supervision or approval of a parent or guardian or other responsible adult, in accordance with applicable law. If You have reason to believe that a minor child has provided Personal Information to us through the usage of Our Platform, please contact us at grievance@surepathsystems.in and we will endeavour to delete that information. Push Notifications: We may request to send You push notifications from the mobile application/Platform. If You wish to opt out from receiving these types of communications, You may turn them off in Your device’s settings.
COLLECTION OF INFORMATION
The Company will collect personally identifiable information about You when You choose to connect to the Platform using a social networking site (such as Facebook). The Company will collect personally identifiable Information about You only where explicit consent is being accorded to the Company to collect, use, disclose, share and transfer such Information. This information may include details that You authorize the social networking site to share with Us, such as Your public profile, birthday, current city, workplace, school, and email address. We treat this information as Personal Information and handle it in accordance with this Policy. The Platform may contain links to other websites including Google, Facebook, X (formerly ‘Twitter’), WhatsApp, etc. The Company is not responsible for the privacy practices of such websites which it does not own, manage or control. The Platform and third-party vendors, may use first-party cookies (such as the Google Analytics cookie) and third-party cookies together to inform, optimize, and serve ads based on someone’s past visits to the Platform. The Company shall in no case be liable for any loss or damage sustained by the user arising out of any disclosure (inadvertent or otherwise) of any information relating to bank account, credit or debit card details, if any.
USE OF INFORMATION
We do not sell, trade, or otherwise transfer to third parties Your Information. This does not include trusted third parties who assist Us in operating Our Platform, conducting Our business, or servicing You. We may also release Your information when We believe release is appropriate to comply with the law, enforce Our Platform policies, or protect Ours’ or others’ rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. We may engage, appoint, use or otherwise involve a third-party data processor to process Personal Information on Our behalf, under a valid contract. However, We will be responsible for complying with the provisions of the DPDP Act, in respect of any processing undertaken by Us or on Our behalf by a data processor. We may process the Information You provide in the following manner: Fair use of Your Personal Information; and/or In accordance with this Privacy Policy and as permitted by the applicable law including the DPDP Act; and/or To create, manage and administer Your account on the Platform; and/or To enable You to browse restaurants, menus and offerings available in Your area; and/or To allocate restaurant partners and delivery partners, facilitate order pickup and delivery, share delivery updates and provide live tracking or estimated delivery information to personalize your experience; and/or To communicate with You regarding orders, cancellations, substitutions, payment confirmations, support tickets, refunds, offers, platform updates, security alters and policy changes; and/or To provide customer support, investigate complaints, resolve disputes, respond to queries and maintain service quality; and/or To send You marketing or promotional communications, subject to applicable law and Your communication preferences; and/or o provide certain data to third parties, including payment aggregators and other service providers, as and when required in accordance with applicable law;; and/or To improve the Platform, Our services and offerings; and/or to allow the Platform to function based on information that you have provided as well as the information imported from other sites or applications, or information provided to us by third parties such as your contacts or advertisers; and/or to contact you about mobile applications/website updates, informational and service-related communications, including important security updates; and/or to provide products and services that enable users to network, post information on bulletin boards, view and compare profiles, and career background and experience; and/or Your information, whether public or private shall be used to analyse and suggest any other related product/service that shall be suitable for You; and/or The email address provided by You, may be used to send You information and updates about Us; and/or To avoid fraud and other prohibited or illegal activities; and/or To protect the security or integrity of the Platform, Our business, services and other users; and/or To allow Our professionals, business partners to present customised messages to You; and/or To publish any testimonials or reviews that You may have provided on the Platform. Apart from the general purposes stated above, by managing Your profile or opting in when presented with choices, You have explicitly consented for Us to use Your information, subject to applicable laws, in the following specific ways: To allow You to create an account; To create and manage a user profile for You; To operate the Platform using information provided by You, imported from other applications, or received from third parties (e.g., contacts or advertisers); To send You communications, updates, advertisements, and promotional content; To contact You regarding application/website updates, service-related messages, and important security notifications; To inform You of other services offered by Us or Our affiliates (where "Affiliates" means entities that control, are controlled by, or are under common control with Us); To enable feedback mechanisms and respond to User queries or requests; To conduct surveys, questionnaires, contests, and promotions, and to publish their results (e.g., success stories or winner announcements); To analyse Your activity and search patterns on the Platform and suggest potentially relevant information or services; To help other registered users find and connect with Your profile; To allow sharing of Your profile information with Your connections; To detect, investigate, and prevent any violations of Our policies or applicable law; To generate internal analytics and usage reports; To disclose certain data to third parties, as and when required under law or as part of Our service operations; and For other purposes that You separately authorize as You interact with Us. The Company may use the Information provided by You for internal analytical and research purposes such as auditing, data analysis and research to improve Our products, services and customer communication. We may process Personal Information based on Your consent, for performance of a contract/ agreement with You, compliance with a legal obligation, to protect vital interests of Users or another natural persons, public interest and other legitimate interests. In case of any change in processing the Personal Information of the User, the User shall be duly notified at least 3 (three) days before the change in processing the Personal Information. The notice shall be provided in English and shall be sent through email to the registered email address of the User.
SHARING OF INFORMATION WITH THIRD PARTIES
For the purposes of Our Platform, We may share Your Personal Information with any of Our business partners, administrators, service providers or affiliates for legitimate business purposes, in accordance with applicable law. The Company may share consumer information on an aggregate with its partners or third parties where it deems necessary, as listed above. In the event of an audit, reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Our business, assets or stock (including in connection with any bankruptcy or similar proceedings), We may share/transfer/assign the Information we have collected to the relevant third party. In such cases, Your data may be transferred subject to the acquirer and its affiliates accepting the commitments made in this Privacy Policy and complying with applicable laws. The information provided by You may be shared with third parties including but not limited to restaurant partners and delivery partners. Such sharing is done solely for the purposes described in this Privacy Policy and to facilitate seamless delivery services. By registering with Us, You consent to this sharing of Your information as part of the Platform’s services. Subject to the limited and lawful disclosures set out herein, We may disclose Information, in good faith, wherein the access, use, preservation or disclosure of such information is reasonably necessary to (i) satisfy any applicable law, regulation, legal process or enforceable governmental request, (ii) detect, prevent, or otherwise address fraud, security or technical issues, or (iii) protect against imminent harm to the rights, property or safety of the Company, its users or the public as required or permitted by law. However, We do not share or disclose Your personally identifiable contact information including but not limited to Your name, phone number, or email address to any external third party without Your consent. We may share certain information that does not personally identify You but is unique to Your use of the Platform, such as demographic or usage data submitted at the time of account registration. When We share such information for instance, with advertisers, users, or partners we ensure that it is not linked to Your name or other personally identifiable details. This may include aggregated usage statistics or anonymized insights used for analytics, service improvements, or marketing purposes.
DATA RETENTION
Your personal data will not be kept for longer than is necessary to fulfil the specific purposes outlined in this Privacy Policy, and to allow Us to comply with relevant legal requirements. Any data We do hold onto will be anonymous. Your personal data, associated traffic data and other logs of the processing will be deleted after a period of 1 year from the termination of use of our services, with a prior intimation to You. The rest of the data is therefore anonymous and will be used to analyse general market and website trends but without an identifiable personal information.
ACCOUNT AND DATA DELETION
This section explains how You can request deletion of Your Zipkee account and the personal data associated with it. The Zipkee applications (Zipkee, Zipkee Rider and Zipkee for Restaurants) are operated by Surepath Systems India Private Limited. How to request deletion: Send an email to Our Data Protection Officer at mahalakshmi@surepathsystems.in from, or quoting, the mobile number registered with Your account, using the subject line "Delete my account". You may also write to Our Grievance Officer at perumal@surepathsystems.in. We may ask You to verify Your identity before acting on the request, and We will process a verified deletion request within 30 (thirty) days. What is deleted: Upon a verified request, We delete Your account and the personal data linked to it, including Your name, email address, mobile number, delivery and billing addresses, saved preferences, device identifiers, and location history. What is retained, and for how long: We may retain certain records where retention is required to comply with applicable law, or to resolve disputes and prevent fraud - for example order, invoice, payment and tax records, which are retained for the period required under applicable tax and accounting laws and are deleted once that period expires. We do not store Your complete payment instrument details (these are handled by Our payment gateway partners). Any residual data We retain for analytics is anonymised and can no longer identify You.
RIGHTS AVAILABLE TO USERS
You can at any time withdraw Your consent for collection and use of Your Personal Information. However, Your decision to withdraw Your consent will not affect the processing of Personal Information based on Your previous consent. Within a reasonable time from withdrawal of Your consent, we will cease and cause data processors to cease processing of Your Personal Information, unless such processing is required or authorised under applicable law. Users have rights when it comes to how their Personal Information is handled. These rights may vary depending on applicable laws, but may include the right to: review the Personal Information and non-personal Information the Company maintains about the User; know whom the Company has shared the Personal Information with; access, review, correct or amend the Personal Information; request deletion of the Personal Information; withdraw the consent given to the terms of the Privacy Policy; be intimated by Us upon occurrence of any breach of your Personal Information; give, manage, review or withdraw Your consent to Us, through a consent manager registered with the Data Protection Board of India (“Board”); nominate and intimate us of any other individual who shall, in the event of Your death or incapacity, exercise Your rights under applicable law; raise a complaint with relevant authorities (including the Board) about our collection and use of Your Personal Information. Under the GDPR, You have the following rights with respect to Your information: Right to be informed: You have the right to be informed about what information is being collected, and how it is being used. Right of access: You have the right to access and receive a copy of Your data. Right to rectification: You have the right to correct any inaccurate data, or complete any incomplete data. Right to erasure: You have the right to request the erasure of your data, under the following circumstance: The data has been collected or processed in contravention with relevant laws; The data is no longer required for the provision of our services; You wish to withdraw your consent for the use of Your data; or Such erasure is necessary for compliance with any laws in force at the applicable time and jurisdiction. Right to restrict processing: You have the right to request us to restrict the use of the data You have provided, but continue to retain it in our database. Right to data portability: You have the right to request a copy of Your personal data for personal use and/or to have their personal data transmitted to another party. Right to object to processing: You have the right to object to the processing of Your personal data in certain circumstances such as for direct marketing purposes. Rights in relation to automated decision making and profiling: You have the right not to be subject to a decision that is based on: Automated individual decision-making - Making a decision solely by automated means without any human involvement. Profiling - Automated processing of personal data to evaluate certain things about an individual. Depending on the circumstances and the nature of Your request it may not be possible for Us to do what You have asked, for example, where there is a statutory or contractual requirement for Us to process Your data and it would not be possible to fulfil Our legal obligations if We were to stop. However, where You have consented to the processing, You can withdraw Your consent at any time by emailing the Data Protection Officer. In this event, We will stop the processing as soon as such processing is no longer necessary for the provision of the Products/Offerings. If You want to exercise any of the rights described above or are dissatisfied with the way we have used your information, please contact Our Data Protection Officer. We will seek to deal with your request without undue delay, and in any event in accordance with the requirements of the GDPR. Please note that We may keep a record of Your communications to help us resolve any issues which You raise. If You remain dissatisfied, You have the right to lodge a complaint with the Information Commissioner's Office at the ICO website. You may exercise Your rights of accessing, updating and rectifying of documents, or revocation of consent by contacting the Data Protection Officer or mahalakshmi@surepathsystems.in, details of whom are provided within this Privacy Policy. Please note that we may ask You to verify Your identity before responding to such requests. If You make a request, We will try Our best to respond to You and address the issue as soon as possible. We reserve the right to retain Personal Information as may be required to comply with legal obligations or Our business model for a limited period, until such time we have the necessity to store Your Personal Information.
SECURITY AND DISCLAIMERS
We use reasonable security measures to protect Information from unauthorized access, maintain data accuracy and help ensure the appropriate use/disclosure of Information. We host the Platform in a secure server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders. To protect against loss, misuse and alteration of the Information under its control, the Company has in place appropriate physical, electronic and managerial procedures. For example, the Company’s servers are accessible only by authorized personnel and Your Information is shared with employees and authorized personnel on a need-to-know basis. We may, with Your consent, publish Your testimonials and reviews given by You in relation to the services received from us. You agree that we may edit the testimonials or reviews provided by You and republish the edited version. If You have any concern with the edited testimonial or reviews, You can contact through e-mail to the Grievance Officer, the details of whom are provided within this Privacy Policy. Although We will endeavour to safeguard the confidentiality of Your Personal Information, transmissions made cannot be made absolutely secure. You agree that We will have no liability for disclosure of Your information due to errors in transmission or unauthorized acts of third parties. The rights and obligations under this Privacy Policy may fall away in special/grave circumstances, in accordance with applicable law. This shall include (i) prevention, detection, investigation or prosecution of any offence under applicable law, (ii) processing necessary for any compromise, arrangement, merger or amalgamation involving the Company, and (iii) enforcing any legal right or claim pursuant to a judicial process, or (iv) other events as notified by the Central Government.
COOKIES
The Company may use ‘cookies’ to personalize Your experience on the Platform and to display advertisements or send You emails of offers of Your interest (provided You have not opted out of receiving such emails). Cookies are small pieces of information that are stored by Your browser on Your device's hard drive. Cookies allow You to easily access Our Platform, by logging You in without having to type Your login name each time. By using this Platform, You agree that we can place cookies on Your computer or device as explained above. However, most browsers will allow You to delete them on an individual basis or block cookies from particular or all websites. In the event of You deleting all cookies, You will lose any and all preferences You have set including Your preference to opt-out from cookies.
LINKS TO THIRD PARTY SITES
The Platform may include links to third party applications/websites/Platforms (“Third-Party Sites”). Such Third-Party Sites are governed by their respective privacy policies, which are beyond Our control. Once You leave Our Platform, use of any information You provide is governed by the privacy policy of the operator of the Third-Party Site You are visiting. That policy may differ from Ours. We utilize the data You provide to assess Your potential interest in services offered by specific third parties. Based on this, We may display targeted advertisements to You on Our Mobile Application, website, or other platforms operated by business partners with whom We maintain a relationship. We do not provide any Personal Information or personally identifiable information to third party websites/advertisers/ad-servers without Your consent. We implement reasonable safeguards to protect Your information from unauthorized access or misuse by third parties. However, We do not have control over the practices of these third parties and therefore cannot be held responsible for their handling of Your information. We strongly recommend that You review the privacy policies of any third-party sites You visit. If You cannot find the privacy policy of any of these Third-Party Sites, You may contact the relevant Third-Party Site directly for more information.
ADVERTISING
We use third-party service providers to display ads on Our behalf across the internet and sometimes on this Platform. They may collect anonymous information about Your visits to Our Platform. They may also use information about Your visits to this and other websites to target advertisements for goods and services. Such Third Party Sites are governed by their respective privacy policies, which are beyond Our control. No personally identifiable information is collected or used in this process.
YOUR CONSENT
By using the Platform and/or by providing Your Information, You consent to the collection and use of such Information in accordance with this Privacy Policy, including but not limited to Your consent for sharing Your Information as per this Privacy Policy. You specifically agree and consent to us collecting, storing, processing, transferring and sharing Information (including Personal Information) related to You with third parties, professionals or to registered business partners/users for the purposes as set out in this Privacy Policy.
UPDATES TO THE POLICY
The Company reserves the right to change or update this Privacy Policy at any time and will give You prior notice or information, prior to such changes becoming effective. We will continue to process Your Personal Information in accordance with the revisions, only upon receipt of your renewed consent for the modifications. If You do not consent to the updated Privacy Policy, You may withdraw consent in the manner set out in Paragraph 7.1.
ROLE OF THE COMPANY
The Company operates the Platform to enable Users to access, place orders for, and receive food from identified restaurant partners. The Company does not manufacture, prepare, cook, package or independently verify the food made available by such restaurant partners through the Platform. By using the Platform, You agree that the Company has no control over the foods delivered by the Company and shall not be liable for the quality and quantity of the food delivered. The identified restaurant partners shall be responsible for the quality, safety, hygiene, ingredients, preparation, packaging, labelling and fitness for consumption of the food supplied by them. To the maximum extent permitted under applicable law, the Company shall not be liable, in any capacity, for any defect, contamination, adulteration, spoilage, mislabelling, allergic reaction, illness, injury, loss or damage arising from such food.
